OMH Defense Verdict Affirmed by 10th Circuit


A small Colorado town was sued for millions by California investors claiming that a municipal lease had been improperly cancelled in violation of constitutional due process. After winning a defense verdict for the town in federal district court, OMH attorneys successfully argued the appeal in the Tenth Circuit, which ultimately affirmed the judgment on the due process claims. OMH attorneys also made strides in reversing Tenth Circuit precedent that suggests punitive damages may be recovered against municipal employees in their official capacities.
